MyVirtualMPC Summer 2023 Aldi Gift Card Sweepstakes Official Rules

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. YOU HAVE NOT YET WON. SOME RESTRICTIONS APPLY. ODDS OF WINNING DEPEND UPON THE TOTAL NUMBER OF ELIGIBLE ENTRIES. OPEN TO ALL MARYLAND PHYSICIANS CARE MEMBERS. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. YOU MUST PROVIDE YOUR EMAIL ADDRESS TO ENTER THE DRAWING.

1. SPONSOR: Maryland Physicians Care, 1201 Winterson Rd 4th floor, Linthicum Heights, MD 21090 (“Sponsor”).

2. ELIGIBILITY: Offered only to Maryland Physicians Care members who are legal United States residents in the state of Maryalnd and who are at least 18 years of age or older at the time of entry. If any winner is an Eligible Entrant but is a minor, a Reward may be awarded in the name of such winner’s parent/legal guardian, who must complete and return to Sponsor any required documentation. Employees of Maryland Physicians Care and each of their officers, directors, and agents and their immediate family or household members are not eligible to participate in the Sweepstakes. All federal, state, and local laws and regulations apply. All federal, state, and local taxes are the responsibility of each winner.

3. ENTRY PERIOD: Entries for each Reward must be submitted online, between July 10 - August 15 2023. Each Eligible Entrant may submit one (1) entry for the Reward drawing, which must be submitted by such Eligible Entrant using the means of entry set forth in these Official Rules. Sponsor’s computer is the official clock for the Sweepstakes. Each entry shall be equally weighted and have the same chance of winning.

4. HOW TO ENTER: Register at app.myvirtualmpc.com/register on the web or by downloading the MyVirtualMPC mobile app. You will need to enter your Maryland Physicians Care Member ID, birthdate, and email address to register. Follow the link you are then emailed to agree to terms and set a password. Once the password is set, registration is complete and you will be entered into the app. By completing registration during the month of August, you are automatically entered to win 1 of 10 Aldi Gift Cards.

5. REWARD, APPROXIMATE RETAIL VALUE, AND ODDS OF WINNING: Sponsor will hold a total of ten (10) Reward drawings for a chance to win one (1) Aldi gift card, Retail Value of each gift card: $25. A winner may win only one (1) reward. All expenses, costs, taxes, or fees associated with the acceptance and/or use of a Reward are the sole responsibility of the winner. The odds of winning a Reward will depend on the number of total entries submitted for the Sweepstakes. Dates, times, deadlines, and Rewards subject to change.

6. RANDOM SWEEPSTAKES DRAWING/AWARD OF REWARD: Within seven (7) business days of the close of the Entry Period, Sponsor will randomly draw ten (10) winners from the eligible entries. The drawing will take place at Sponsor’s offices in Linthicum Heights, MD, or another location designated by Sponsor. Sponsor will notify the selected winners via e-mail and/or phone within five (5) business days of the drawing. To claim a Reward, reply to Sponsor within the time period indicated in your notification or Sponsor may, in its sole discretion, select an alternative potential winner. Sponsor may require you to furnish proof of identification and to provide other documentation before and as a condition of your receiving a Reward. If you are found to be ineligible or not in compliance with these Official Rules, decline to accept the Reward, Sponsor is unable to contact you, or in the event that a Reward or Reward notification is returned undeliverable, or if you fail to submit any required documentation, you will forfeit the Reward, and Sponsor may select an alternative potential winner at random from the pool of Eligible Entrants in the relevant Reward drawing. The right to receive a Reward is non-assignable, non-transferable, and no Reward substitution, exchange, or cash equivalent will be allowed, except by Sponsor who reserves the right to substitute a Reward of equal or greater value as determined by Sponsor. Sponsor will, at its sole discretion, award the Reward after the drawing or will mail the Reward to each winner’s designated address within 3-4 weeks of the drawing.

7. GOVERNING LAW: This Sweepstakes is governed by the laws of the state of Maryland. By entering the Sweepstakes, each entrant consents to the exclusive jurisdiction and venue of the courts of the state of Maryland.

8. BINDING NATURE, WAIVER, RELEASE, INDEMNIFICATION: Sponsor and its officers, directors, employees, owners, affiliates, agents, contractors, and partners (collectively, “Released Parties”) assume no responsibility for any error, omission, interruption, deletion, defect, or delay in the Sweepstakes. Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes. Sponsor and the Released Parties are expressly not liable for any harm that may befall any person as a result of participation in the Sweepstakes or in connection with a Reward. By entering the Sweepstakes, you, on behalf of yourself and on behalf of your heirs, executors, and administrators, agree: (a) to be bound by these Official Rules and by all applicable laws and decisions of Sponsor, which shall be binding and final; (b) TO WAIVE ALL OF YOUR RIGHTS TO BRING ANY CLAIM, ACTION, OR PROCEEDING AGAINST THE SPONSOR OR THE RELEASED PARTIES IN CONNECTION WITH THE SWEEPSTAKES, AN ENTRY, THE DRAWING, OR A REWARD OR ANY COMPONENT THEREOF; AND (C) TO FOREVER AND IRREVOCABLY AGREE TO RELEASE, DEFEND, INDEMNIFY, AND HOLD HARMLESS THE SPONSOR AND THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, LAWSUITS, JUDGMENTS, CAUSES OF ACTION, PROCEEDINGS, DEMANDS, FINES, PENALTIES, LIABILITY COSTS AND EXPENSES (INCLUDING, WITHOUT LIMITATION, REASONABLE OUTSIDE ATTORNEYS’ FEES) THAT MAY ARISE. SPONSOR AND RELEASED PARTIES ARE NOT RESPONSIBLE FOR ANY INJURY OR DAMAGE, WHETHER TO YOU OR TO ANY OTHER PERSON OR TO ANY PROPERTY, RELATED TO OR RESULTING FROM YOUR PARTICIPATION IN THE SWEEPSTAKES, IN ANY ACTIVITY AND/OR ACCEPTANCE OR USE OF A REWARD, OR ANY COMPONENT THEREOF. BY PARTICIPATING IN THE SWEEPSTAKES, OR THE USE OF ANY REWARD, YOU EXPRESSLY ASSUME ALL LIABILITY AND RESPONSIBILITY FOR YOUR PARTICIPATION AND AGREE THAT PARTICIPATION IS SOLELY AT YOUR OWN RISK. IN NO EVENT WILL SPONSOR OR THE RELEASED PARTIES BE LIABLE TO ANY ENTRANT OR ANY THIRD PARTY FOR ANY DIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS, OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE SWEEPSTAKES, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT SPONSOR OR ANY OF THE RELEASED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.

9. PUBLICITY RIGHTS: By accepting a Reward, you agree to allow Sponsor and Sponsor designee, the perpetual right to use your name, biographical information, photos and/or likeness, and statements for promotion, commercial, advertising, and publicity purposes, at any time or times, in all media now known or hereafter discovered, including, but not limited to, on the Internet, without notice, review, or approval and without additional compensation, except where prohibited by law; if requested by Sponsor, you shall provide any requested consents.

10. GENERAL: Sponsor reserves the right to disqualify any individual found, in Sponsor’s sole opinion, to be tampering with the operation of the Sweepstakes, or to be acting in violation of these Official Rules.

11. WINNER’S LIST: You may request a list of the Reward winners, by writing your name and address on a "3x5" card and mailing it in an envelope to: Winners List, “Maryland Physicians Care August 2023 Aldi Gift Card Sweepstakes,” Maryland Physicians Care, 1201 Winterson Rd 4th floor, Linthicum Heights, MD 21090. Winners’ List requests will only be accepted after the end of the Sweepstakes and requests must be received no later than August 15, 2023.
